MAGISTRATES will start sitting on weekends in an unprecedented move as Victoria’s prison overcrowding crisis worsens. Chief Magistrate Peter Lauristen announced today Melbourne’s Magistrates’ Court would sit on Saturdays and Sundays starting this week.
For parties in dispute about parenting arrangements, getting a resolution to (at least) seeing their Children at Christmas is important. If you have not yet obtained a mediation certificate then you may not be able to file in the Court system in time before the cut-off date for hearings before Christmas. Unless certain exceptions are met (as outlined below), section 60I of the Family Law Act (Cth) 1975 states that persons who have a dispute about parenting matters must make a genuine effort to resolve such dispute(s) by family dispute resolution before a parenting order is applied for through the Court.
